Stephanie James Design owns and operates the stephaniejamesdesign.com.au website. By using this website, you acknowledge that you agree to our Privacy Policy and these Terms and Conditions.

Placing an Order

When an order is placed on the stephaniejamesdesign.com.au website you will receive an email order confirmation containing an order number and purchase details. Once dispatch of your order has been completed, you will receive another email detailing the shipping date, tracking information and delivery timeframe estimate.

Custom Commissions

If you wish to pursue a custom commission, please get in touch via the Contact page or by emailing at stephaniejamesdesign@gmx.com. Via email we will discuss your needs and expectations regarding design, colour palette, size, dimension, cost and lead times. Once agreed, you will be invoiced via email. Upon payment, creation of your custom piece will begin.

Payment Options

This website accepts payment via PayPal, Mastercard, Visa, American Express, Diner's Club, JCB, and Apple Pay.

Delivery

All orders are shipped using Australia Post and include tracking, insurance and signature on delivery. Stephanie James Design is not responsible for delays with Australia Post or customs delays and international carrier delays for destinations outside of Australia. Ready-to-hang artworks are dispatched within 5 business days, whereas dispatch times for custom pieces are agreed to on a case-by-case basis.

If you have not received your shipment in the advised estimated timeframe, please contact us so that we can raise the issue with the carrier and locate your delivery.

Buyers are responsible for taxes and import duties that apply to international shipments into their destination country.

Returns

If you change your mind about your purchase and would like to return it, please get in touch within 14 days of receiving the item, stating the order number. Please choose your purchase carefully, as return postage is at the buyer's expense for change-of-mind returns. You will be responsible for posting the item back to us. When received undamaged, we will be able to refund you the purchase cost. If the item is returned to us damaged it cannot be refunded, so shipping with insurance is advised. Custom commissions can only be returned if they arrive faulty or damaged.

If you receive an item that has been damaged in transit, please send an email to stephaniejamesdesign@gmx.com within 48 hours of receiving it with an attached photo of the damaged item. In cases of a damaged item, you will be entitled to a refund of the purchase price and shipping, and will not be responsible for return postage.

Colours

Every care is taken to ensure accurate colour depiction in the product images on this website, however, the actual colours contained in the products may differ slightly from how colours are displayed on your device screen. Such discrepancies are not considered product or service faults. Returns arising from colour discrepancies will be treated as change-of-mind returns and are subject to their conditions.

Privacy Policy

Stephanie James Design is committed to protecting the privacy of its customers and website users. Any personally identifiable information that you submit through or in relation to the website is collected and used by us in accordance with our Privacy Policy.

Intellectual Property

All content on this website is the intellectual property of Stephanie James Design. You must not copy, modify or republish any of this content without first receiving written permission from us.

Limitation of liability

To the fullest extent permitted by law, we exclude any and all liability for any direct or indirect loss, damage, cost or expense, however or wherever incurred, including, but not limited to any loss, damage, cost or expense that results from:

  • your use or misuse of the website or any material on the website;

  • your inability to access or use the website or any material on the website;

  • the loss or modification of information or material transmitted to or from the website;

  • the loss of confidentiality in any information or material transmitted to or from the website;

  • any defect, technical problem or virus attached to or arising from the website or the server;

  • any injury or illness you or any other person sustains as a result of the use of the website; and

  • the products displayed on the website being unavailable at any time.

If we breach any term, condition or warranty which is implied by law and cannot be lawfully excluded, our liability for a breach of the applicable term, condition or warranty is limited to the full refund of purchase amount.

You further agree that:

To the extent that we are not prohibited by law from limiting our liability, then our liability is limited in the same manner above including in respect to any liability that arises as a consequence of our negligence;

Our liability to you for any matter related to the subject matter of these terms and conditions will not include any special, indirect, incidental or consequential damages or loss of profits and will not exceed the cost to you for the particular transaction which has caused you the loss or damage; and

We are not responsible in any way for any liability, loss, damage or expense that arises directly or indirectly from a problem that occurs by any virus infecting this website.

Indemnity

  • You agree that you indemnify us in relation to any cost, loss, liability, or damage that any of you, your client, or a third party suffers:

  • because the product you order is not suitable for its intended purpose or does not suit the relevant circumstances;

  • because you fail to obtain formal advice from a professional adviser concerning whether the product you choose is suitable for its intended purpose or is suitable for particular circumstances;

  • because of the answers you provide to questions asked of you when using our service;

  • because you modify the products after they are provided to you; or

  • because you breach these terms and conditions in some other way. You agree that you continually indemnify us against any cost, loss, liability, or damage that we incur as a result of your use of our service.

  • You also agree to indemnify Stephanie James Design against any and all loss, damage, demand, cost or expense claimed by a third party as a result of or in connection with your use of or conduct on the website.

Governing Law

Stephanie James Design operates in New South Wales, Australia. The laws of the state of NSW and the Commonwealth of Australia govern these Terms and Conditions.

Severance of Clauses

If any clause of these Terms is held to be invalid, void, unlawful or unenforceable for any reason, that clause will be severed from the Terms and it will not affect the validity and enforceability of the remainder of the Terms.

Revisions to These Terms

Stephanie James Design reserves the right to revise these Terms and Conditions at any time without prior notice, and such revisions will take effect immediately.
